Why do I need to file my business name?

State law requires that you do. Also, most banks require the document to open a business bank account and some city clerks want to see it before they will issue a business license.

Why do I need to publish?
Business and Professional Code 17918 specifies “No person transacting business under a fictitious business name contrary to the provisions of this chapter, or his assignee, may maintain any action upon or on account of any contract made, or transaction had, in the fictitious business name in any court of this state until the fictitious business name statement has been executed, filed, and published as required by this chapter. For the purposes of this section, the failure to comply with subdivision (b) of Section 17917 does not constitute transacting business contrary to the provisions of this chapter.”

The fee in Los Angeles is $26.00 for the first Fictitious Business Name and one registrant and $5.00 for each additional business or registrant name.

State law also requires that within 30 days the registrant must publish the statement in a newspaper of general circulation in the county where the statement was filed.

What if I forget to publish within the required 30 days?
DBA 4 Less can re-file the name for you (you must pay another $26) and publish the new filing.

Do I need to renew?
Yes, every five years after your first filing date.

Will I receive a confirmation in the mail?
NO, nothing will be mailed to you or your business. The county no longer sends a free confirmation of publication.
